Travis D. Finchum, Esq.
President
Special Needs Lawyers, PA

Travis D. Finchum has been practicing law since 1996 and has been a Board Certified Elder Law attorney since 2002.  He is the President and founder of the law firm Special Needs Lawyers, P.A.  Mr. Finchum specializes in Medicaid qualification for aged and disabled individuals as well as Special Needs Trust drafting and administration.  His practice also consists of estate planning, probate, trust administration and guardianship, with a special emphasis on helping families plan for a member with special needs.  He also helps families plan for incapacity through alternatives to guardianship.

He is a past Chair of the Special Needs Trust Committee of the Florida Bar’s Elder Law Section and previously served on and Chaired the Elder Law Board Certification Committee of the Florida Bar.  Mr. Finchum serves on the Board of Directors for the Arc Tampa Bay, the Advisory Board for the National Alliance on Mental Illness, Pinellas County Chapter and on the Guardian Trust Foundation, Inc. He is also a liaison between the Real Property, Probate and Trust Law Section and the Elder Law Section and sits on both of their Executive Councils.

Mr. Finchum founded the Guardian Trusts in 2002, and serves as a Co-Trustee of their trusts which assist individuals with disabilities in protecting their assests for use during their lifetimes without disqualifying them for much needed public benefits. Victoria Elizabeth Heuler has been an attorney since 1993 and an active Elder Law Attorney since 2000 with an emphasis in incapacity matters, guardianship and related litigation. Victoria is a Board Certified Specialist (B.C.S.) by the Florida Bar in the area of Elder Law and has been continuously certified since 2007. Victoria is a member in good standing of both the Florida and Georgia bars. She also handles matters involving the protection of elder rights, representation of fiduciaries and agents, end-of-life issues and advanced directives, advocacy and representation in matters involving exploitation of vulnerable adults, and estate and trust administration. Victoria is a leader in educational discussions on topics related to aging, vulnerable adults and protection of individuals as they age.

Victoria is an active leader in the Florida Bar’s Elder Law Section and has held various leadership posts, including currently serving as its Administrative Vice Chair. She is past-President of the Academy of Florida Elder Law Attorneys (2007-2008); a member of the National Academy of Elder Law Attorneys (NAELA) and former Committee chairwoman; past President of the Big Bend Chapter of the Florida State Guardianship Association; and past President of the Board of Directors for Tallahassee’s Alzheimer’s Project. Victoria currently serves on the board of directors for Elder Care Services in Tallahassee and is Vice Chair.

Victoria enjoys spending time with her husband, George (a retired professional geologist), and their rescue animals Sophie (pug mix), and Aspen (fluffy white cat), playing tennis or riding her mountain bike on one of the beautiful Tallahassee trails, and traveling to visit their two daughters. Victoria is blessed to have her octogenarian parents in Tallahassee and is ever thankful for their wellness and her time with them.

Howard’s practice is devoted to elder law and trust and estate matters, including representing seniors and people with special needs and their families in connection with asset preservation planning, supplemental needs trusts, Medicaid, Medicare, planning for disability, guardianship, wills, trusts, and health care planning with advance directives. 

Howard is certified as an elder law attorney by the National Elder Law Foundation and currently serves on the Executive Council of the Florida Bar Elder Law Section as the chair-elect and the board of trustees of the NAELA Foundation. Howard received the 2006 Outstanding Achievement Award from the New York Chapter of NAELA for serving as co-chair of a Special Committee on Medicaid Legislation formed by the NYSBA Elder Law Section to oppose New York Governor George Pataki’s budget bills containing numerous restrictive Medicaid eligibility provisions that, if enacted, would severely impact the frail elderly and disabled populations. He was named Member of the Year in 2010 by the Florida Bar Elder Law Section for his work in obtaining Medicaid approval for the use of promissory notes in Medicaid planning in Florida. He also was recognized for serving as co-chair of the NYSBA Elder Law Section Compact Working Group, which received national attention for developing alternative methods of financing long-term care. Additionally, Howard served as chair of a Special Committee created by the NYSBA Elder Law Section to address the Statewide Commission on Fiduciary Appointments formed by Chief Justice Judith Kaye. Howard received an award for spearheading the effort on behalf of NAELA seeking the enactment of the Special Needs Trust Fairness Act, which was signed into law by President Obama on December 13, 2016. 

Howard has consistently been selected as a Florida Super Lawyer and a New York Super Lawyer, named to Florida Trend’s Legal Elite, a Top 25 Westchester County Attorney, and is AV Preeminent rated by Martindale-Hubbell. 

Howard is a frequent lecturer and has addressed many organizations, including Barron’s, NAELA, Stetson Special Needs Conference, ALI-ABA, WealthCounsel, ElderCounsel, the National Guardianship Association, various bar associations and attorney organizations, estate planning organizations, Berkeley College, the United Federation of Teachers, the New York State United Teachers, and the New York State Civil Service Employees’ Association. He has been quoted in The Wall Street Journal, The New York Times, Kiplinger’s, USA Today, The New York Post, Newsday, The Journal News, and the Boca Raton News. Howard has appeared on PBS, the CBS Early Morning Show, and local elder law focused television programs. Howard has written extensively on the topic of elder including “Creative Advocacy in Guardianship Settings: Medicaid and Estate Planning Including Transfer of Assets, Supplemental Needs Trusts and Protection of Disabled Family Members,” included in Guardianship Practice in New York State and “Long-Term Care Insurance in New York,” included in Estate Planning and Will Drafting in New York, both published by the New York State Bar Association.

Collett P. Small is a founding Partner of Slater & Small PLLC.  She served as the Chair of the Elder Law Section of the Florida Bar 2017-2018. Collett is Board Certified by the Florida Bar as a Specialist in Elder Law. Collett serves on the Florida Bar’s Special Committee on Opportunity in the Practice of Law in Florida and on the Continuing Legal Education Committee. Mary L. Wakeman devotes her practice to elder law and related issues, with an emphasis on estate planning, incapacity planning, special needs trusts, and estate and trust administration.
