We are thrilled to announce our outstanding 11th Annual Advanced Appellate Practice Two-Part Webinar.

Our esteemed speakers encompass a distinguished group of justices and judges from across the state. This year we are happy to announce the following CA Appellate Court Justices joining our program:  Hon. Douglas P. Miller, Hon. Maria E. Stratton and Hon. Daniel H. Bromberg. Also joining us this year are Superior Court Judges Hon. Kira Klatchko, who is also a Certified Legal Specialists in Appellate Law, and Hon. Curtis E. A. Karnow, who is steeped in what is going on with AI at all level of the courts.

We expect to announce many more CA Appellate Justices shortly, as usual.

The program is also taught by a host of seasoned appellate attorneys. The majority among them hold the distinction of being Certified Legal Specialists in Appellate Law, and many have previously served as staff attorneys for various appellate justices.

Designed for those well-versed in appellate practice, this seminar delves into intermediate to advanced level topics in appellate law and practice, and assumes attendees already have a foundational understanding of the subject matter.

Hon. Douglas P. Miller
Justice
California Court of Appeal, Fourth Appellate District, Division Two

Justice Miller was born in Whittier, California, and grew up in Glendora, California.  He attended Brigham Young University in Provo, Utah and graduated with a Bachelor of Arts degree in Economics in 1975.  Justice Miller was awarded his Juris Doctor in 1978 from Pepperdine University School of Law.  He practiced law at the Law Offices of Thomas T. Anderson in Indio, California, from 1978 through 1995.

In 1995 Justice Miller was appointed to the Riverside Superior Court by Governor Pete Wilson.  His first year he was assigned criminal trials but the remainder of his time with the superior court was spent in primarily civil trials.  He served as the Presiding Judge in the Riverside County Superior Court from January1, 2003, through December 31, 2004.  In 2006 Justice Miller was voted Trial Judge of the Year by the American Board of Trial Advocates (ABOTA), Inland County.  In June of 2006 Justice Miller was appointed to the Fourth District Court of Appeal, Division Two, by Governor Arnold Schwarzenegger.

Justice Miller has served on many state and local committees including the California Judges Association.  He is currently serving on the Judicial Council, as Chair of the Executive and Planning Committee; the Commission on the Future of California’s Court System; Chair of the Commission for Impartial Courts’ Task Force on Judicial Candidate Campaign Conduct; the Commission on Access to Justice; Chair of the of the California Court Case Management System Justice Partner Advisory Committee; and Vice Chair of the Supreme Court Committee on Judicial Ethics Opinions. 

Justice Miller is also active in many local programs including the Boys & Girls Club, of which he is currently the President and also on the National Area Council Committee; and he is a founding member of the Warren E. Slaughter American Inn of Court.  In his spare time, Justice Miller enjoys fly-fishing, tennis and hiking.

 


Hon. Maria E. Stratton
Presiding Justice
California Court of Appeal, Second Appellate District

Justice Stratton was born in Santa Monica, California and raised in San Diego, her father’s last duty station in the United States Navy.  She graduated magna cum laude and Phi Beta Kappa from the University of Southern California and received her law degree from Boalt Hall at the University of California, Berkeley (now Berkeley Law).   She served as law clerk to United States Circuit Judge Harry Pregerson at both the U.S. District Court (before his elevation) and the United States Court of Appeals for the Ninth Circuit.   

After clerking, Justice Stratton worked as a Deputy Federal Public Defender at the Office of the Federal Public Defender for the Central District of California in Los Angeles.  She was an associate at Overland, Berke, Wesley, Gits, Randolph and Levanas for a short time before joining Talcott, Lightfoot, Vandevelde, Woehrle & Sadowsky where she practiced criminal and civil litigation for ten years as an associate, partner, and a managing partner.   

In 1993, the United States Court of Appeals for the Ninth Circuit appointed Justice Stratton as the Federal Public Defender for the Central District of California where for twelve years she directed an office of 60 attorneys representing indigent federal criminal defendants at the trial and appellate levels and on post-conviction habeas corpus review.   She has served on the Ninth Circuit Capital Case and Capital Cost Oversight Committees and the Ninth Circuit Gender Bias Task Force Los Angeles Working Group.    

In 2005, Governor Schwarzenegger appointed Justice Stratton to the Los Angeles County Superior Court, where she served as Assistant Supervising Judge of the mental health departments of the criminal division, Assistant Supervising Judge of the Van Nuys courthouse, and Supervising Judge of the probate division.   From 2006 through 2018, she tried over 60 civil and criminal cases to jury verdict and presided over hundreds of civil and criminal bench trials.  Justice Stratton is also active in bench and bar education.   


Hon. Curtis E.A. Karnow
Judge
Superior Court of California, San Francisco County

Judge Curtis E.A. Karnow serves on the Superior Court (County of San Francisco). He has served in the complex litigation department, and is past Presiding Judge of his court’s Appellate Division. He served on Judicial Council task forces and working groups on appellate division rules, temporary judges, electronic discovery, e-filing, and electronic access, as well as the California Supreme Court Committee on Judicial Ethics Opinions.  He was a member of the Council’s Committee on Civil & Small Claims, chairing the subcommittee on discovery and rules reform, assisting in drafting rules on e.g., case management, electronic discovery, sealing records, and summary judgment. 

Judge Karnow is a graduate of Harvard College and his J.D. is from the University of Pennsylvania, where he was an editor of the Law Review.  He is author of or contributor to 16 books in the legal field, including his Litigation In Practice and co-author of the Rutter Guide-Civil Procedure Before Trial, as well as other books and articles including on the legal process, discovery, experts, settlement, class actions, summary judgment, statistics, implicit bias, bail, and artificial intelligence (about 70 articles and manuals) available at https://works.bepress.com/curtis_karnow/. 

He authors Sidebar: The Podcast (civil procedure topics for judges such as contracts, experts, attorney fees, primary rights, arbitration, class actions, motions in limine, etc.) and has lectured at law schools including Yale, University of San Francisco, Stanford, Hastings, and New York University, and has taught civil litigation to new and experienced California judges.  Judge Karnow is a member of the American Law Institute (ALI), and received the California Judges Association’s Bernard Jefferson Award for Distinguished Service in Judicial Education.


Hon. Kira L. Klatchko

Judge Kira Klatchko was appointed to Riverside County Superior Court in 2016. She currently sits in Palm Springs in an unlimited civil department.

Before joining the bench, Judge Klatchko was a Civil Appellate Law Specialist, certified by the State Bar of California Board of Legal Specialization and handled both state and federal appeals arising from all areas of civil practice for clients as varied as cities, businesses and families. Judge Klatchko was a partner at Lewis Brisbois, and served as was vice chair of the firm’s national Appellate Practice Litigation group. Prior to joining Lewis Brisbois, Judge Klatchko was a partner at Best Best & Krieger where she served as chair of the firm’s appellate group. She served for six years on the State Bar of California’s Standing Committee on Appellate Courts, including a term as its chair.

Judge Klatchko is co-author of the “California” chapter of the “Appellate Practice Compendium” (ABA 2012), an insider’s guide to appellate practice. She is co-contributing editor of “California Civil Appeals and Writs” (Matthew Bender 2014), a comprehensive two-volume practice guide for appellate counsel and general litigators. Judge Klatchko was repeatedly named to the list of Super Lawyers for Southern California in Appellate Law. She is a former president of the Riverside County Bar Association, and previously served five terms as chair of the Riverside County Bar Association Appellate Section. Judge Klatchko was also a member of the California Academy of Appellate Lawyers.

Judge Klatchko has served as an adjunct professor at La Verne College of Law, teaching legal research and writing. She has also lectured on appellate ethics and practice at numerous conferences and seminars, including the California State Bar Annual Convention, the State and Local Legal Center Supreme Court Practice Seminar, and Pincus Professional Education’s Annual Advanced Appellate Conferences in Los Angeles.  

In 2014, Judge Klatchko was inducted into the Desert Bar Association Hall of Fame, as Outstanding Young Attorney of the year. In 2010, Judge Klatchko was recognized by the City of Palm Springs and Palm Springs Chamber of Commerce with the Athena International Award for Young Professional Leadership, recognizing her professional success and work in the community. 

Judge Klatchko received her bachelor’s degree in political science, with distinction, from the University of California, Berkeley. She earned her master’s degree in business administration from the Executive Management Program at the Peter F. Drucker and Masatoshi Ito School of Management at Claremont Graduate University. She earned her law degree at the University of California, Davis, School of Law, where she served as editor-in-chief of the U.C. Davis Journal of Juvenile Law & Policy.

Michael G. Colantuono is a shareholder in Colantuono, Highsmith & Whatley, a municipal law firm with offices in Pasadena and Grass Valley. Chief Justice Ronald M. George presented him with the 2010 Public Lawyer of the Year award on behalf of the California State Bar Association. The Los Angeles Daily Journal named him one of “California’s Top Municipal Lawyers” every year since its list began in 2011. The Supreme Court appointed him the first Chair of the Board of Trustees of the State Bar of California; he was previously President of the Bar. Appellate work and legal writing have been a significant part of Mr. Ehrlich’s practice since he was first admitted to practice law in 1985. As an associate with the Los Angeles law firm of Hufstedler, Miller, Carlson & Beardsley, Mr. Ehrlich was privileged to work with and be trained by brilliant lawyers like retired California Supreme Court Justice Otto Kaus and retired Federal Circuit Judge Shirley Hufstedler. Mr. Ehrlich’s ability to draft legal arguments and to present them effectively has also resulted in many favorable, but unpublished, decisions in the trial and appellate courts. While these decisions affect only the parties involved in the litigation, they often involve critical aspects in the case on which the entire litigation turns. For example, defeating a defendant’s summary-judgment motion in the trial court is often the key to forcing a defendant to settle a case. Like his colleagues at GMSR, Jeff specializes in appeals but is a subject-matter generalist. He handles civil appeals and writ petitions in a wide spectrum of business and public entity disputes and cases involving tort law, contract law, family law, and consumer law, to name just a few. Jeff regularly briefs and argues appeals in both California and federal appellate courts. He also consults with trial attorneys before, during, and after trial to advise on key legal issues, assist in drafting dispositive post-trial motions, and help prepare the attorneys and clients to pursue or defend against any subsequent appeal.

In addition to serving his clients’ needs, Jeff assists GMSR partner Laurie Hepler in her role as Contributing Editor of Eisenberg, Cal. Practice Guide: Civil Appeals and Writs (The Rutter Group), the authoritative treatise on civil appellate practice in California. He regularly speaks to both large and small groups of trial lawyers to provide helpful appellate law developments and advice about how to prepare and preserve their trial record to increase their chances of prevailing in any future appeal.

 Throughout his career in private practice, Dan Lawton has focused on civil trial work and complex commercial and intellectual property litigation on behalf of both plaintiffs and defendants. He also has a deep background in civil appeals, and is certified as a legal specialist in Appellate Law by the State Bar’s California Board of Legal Specialization. The certification is a distinction held by only 36 lawyers in San Diego County. His first job out of law school was a clerkship with Ninth Circuit Judge Thomas Tang.

Matt Stucky spent nearly a dozen years learning how the justices of the California Court of Appeal decide cases.

As the supervising writs attorney at the Fourth District, Division One, of the California Court of Appeal in San Diego, Matt worked with the justices to review thousands of writ petitions. He advised the court on recommended dispositions for every type of petition and learned to differentiate between petitions destined for a summary denial and for writ relief. Before supervising the writs department, Matt collaborated with justices to draft hundreds of appellate opinions on scores of issues, including land use and environmental review, business and commercial litigation, real property, family law, employment, lawsuits involving public entities, civil procedure disputes, and anti-SLAPP law.

Before joining the court, he handled appeals in private practice.

Matt previously specialized in civil appeals with a large California law firm, where he drafted appellate briefs filed in California Courts of Appeal and the Ninth Circuit Court of Appeals. He also regularly advised trial attorneys and drafted dispositive and post-judgment motions on complex legal issues to ensure they were preserved for appeal.

Matt has been involved with numerous San Diego civic organizations.

In recent years, he served with the North Park Community Planning Committee, the North Park Maintenance Assessment District Advisory Board, and the Circulate San Diego Policy Committee.

He graduated from the George Washington University Law School with honors.

Matt was a Notes Editor of the George Washington International Law Review, a member of the Student Bar Association, and he externed in law school with the California Court of Appeal, Fourth District, Division Three. Hon. Daniel H. Bromberg
Associate Justice
California Court of Appeal, Sixth Appellate District

Daniel H. Bromberg was appointed to the Court of Appeal, Sixth Appellate District, by Governor Gavin Newsom in January 2023. 

From 2019 to 2021, Justice Bromberg served as a Deputy Secretary for Legal Affairs in the Governor’s Office, where he supervised lawyers in the California Environmental Protection Agency, Natural Resource Agency, Department of Transportation, and Department of Food and Agriculture. During this period, Justice Bromberg also supervised litigation concerning, among other things, the border wall and COVID-19 restrictions. 

Both before and after serving in the Governor’s Office, Justice Bromberg was in private practice. He began his career as an associate at Cahill Gordon & Reindel in New York, working primarily on First Amendment matters. He subsequently moved to JonesDay in Washington, D.C., where he became a partner in the appellate practice. In 2005, he moved to California to join Quinn Emanuel Urquhart & Sullivan, where he helped found the appellate practice group and remained until joining the Governor’s Office. After leaving the Governor’s Office, Justice Bromberg joined Pillsbury Winthrop Shaw Pittman in San Francisco as the head of the firm’s appellate practice. 

Mr. Bromberg graduated summa cum laude with a B.A. in history from Yale University and magna cum laude with a J.D. from Harvard Law School, where he was a member of the Law Review. He clerked for the Honorable Louis F. Oberdorfer on the United States District Court for the District of Columbia Circuit and then for the Honorable A. Raymond Randolph on the United States Court of Appeals for the District of Columbia Circuit. 

Justice Bromberg has taught continuing legal education classes on writing and appellate practice. In addition, in 2021 and 2022, he was a senior research fellow at the California Constitution Center at the Berkeley School of Law. During the same period he was a senior appellate practice fellow in the Center for Litigation and the Courts at UC College of the Law, San Francisco and the founding director of the California Appellate Advocacy Project.

Judge Curtis E.A. Karnow serves on the Superior Court (County of San Francisco). He has served in the complex litigation department, and is past Presiding Judge of his court’s Appellate Division. He served on Judicial Council task forces and working groups on appellate division rules, temporary judges, electronic discovery, e-filing, and electronic access, as well as the California Supreme Court Committee on Judicial Ethics Opinions.  He was a member of the Council’s Committee on Civil & Small Claims, chairing the subcommittee on discovery and rules reform, assisting in drafting rules on e.g., case management, electronic discovery, sealing records, and summary judgment.

Kirstin Ault, Esq.

Kirstin Ault spent more than a decade handling criminal appeals for the federal government.

Kirstin has over 20 years of appellate experience, and has litigated more than 50 appeals before the Ninth Circuit Court of Appeals. She spent 15 of those years with the U.S. Attorney’s Office for the Northern District of California, where her work included, along with direct criminal appeals, challenges to sentencing, restitution orders, and conditions of supervised release and probation, as well as interlocutory appeals challenging bail conditions and rulings on trial motions.

She has special expertise in constitutional challenges to criminal convictions and statutory interpretation.

As the Supreme Court’s jurisprudence on the vagueness doctrine evolved to impact a variety of criminal and immigration statutes, Kirstin coordinated with other offices in the Ninth Circuit and the U.S. Department of Justice to develop a coherent strategy for adapting to a rapidly changing area of constitutional law. Kirstin also served in the U.S. Attorney’s Office’s Economic Crimes and Securities Fraud section where, as Health Care Fraud Coordinator, she oversaw the Northern District’s health care fraud litigation and handled a variety of white-collar cases.

Kirstin has also tried over 20 federal jury trials, and brings that trial strategy and motions experience to benefit her consulting and appellate clients.

Kirstin was recognized as one of the Top 100 Lawyers in California by the California Daily Journal in 2014. She received the Executive Office of United States Attorneys Director’s Award in 2016. She currently serves on the Women Lawyers Association of Los Angeles Amicus Committee and the Women’s White Collar Defense Association Small Firms Initiative Committee.

Susan Horst is a specialist in writs of mandamus and prohibition in the California appellate courts. For more than 31 years, Susan served as the writ attorney for the California Court of Appeal for the First District, Division One, in San Francisco. Her practice today focuses on writ petition consulting in the appellate courts and trial court work in anticipation of writ relief. Susan also lectures widely on writ practice and procedure. She has presented seminars to the San Francisco City Attorney, District Attorney and Public Defender Offices, the State Bar of California, California Continuing Education of the Bar, The Rutter Group, PINCUS Professional Education, bar associations across California, and the Center for Judicial Education and Research. She is the co-author of Chapters for Continuing Education of the Bar publications, as well as training materials for numerous continuing education lectures.

Susan’s career at the Court of Appeal followed motion and jury trial skills she developed early on as an Assistant District Attorney in San Francisco. She holds her J.D. from the Santa Clara University School of Law, where she graduated summa cum laude — even though she attended law school part-time at night, while working as a full-time administrator at Stanford University during the day. She also has her B.A. in English from Stanford.

In her spare time ,she also volunteers on the Advisory Board of Advokids, a foster children’s advocacy group, and provides pro bono advice and representation through the Advokids Appellate Project.
