🔍 What You’ll Learn:
Whether you are seeking attorney’s fees and costs or opposing a fee request, obtaining—or avoiding—a substantial fee award often depends on far more than simply prevailing in the case. From establishing entitlement and proving a reasonable fee to preparing persuasive billing records and presenting a compelling fee petition to the court, attorney’s fees and costs requests present numerous strategic and procedural challenges that can significantly affect the amount ultimately awarded.
This practical webinar will guide attorneys through every stage of preparing, supporting, challenging, and presenting attorney’s fees and costs requests.
Your faculty, including a sitting judge, will explain when attorney’s fees are recoverable under Florida law, how courts analyze fee entitlement, and how to navigate the exceptions to the American Rule, including contractual fee provisions, statutory fee awards, proposals for settlement, sanctions, and voluntary dismissals. They will also discuss Florida’s lodestar methodology, including how courts evaluate reasonable hourly rates and reasonable time expended, as well as effective strategies for supporting—or challenging—a fee request.
One of the most critical components of any fee request is the supporting documentation.
Your faculty will teach you how to prepare detailed, defensible billing records, avoid common billing mistakes that can reduce or defeat a fee award, challenge excessive or inadequately documented time entries, and address issues such as block billing, overstaffing, vague descriptions, and when compensable time begins and ends.
They will conclude with practical guidance on preparing persuasive fee petitions, presenting requests for attorney’s fees and costs to the court, and maximizing the likelihood of a successful award.
Attendees will also receive a sample proposed fee order they can adapt for their own practice.
