Summary judgment can end a case or save one, but only if it’s handled strategically. This focused Winning Motions for Summary Judgment: From Discovery Strategy to Persuasive Writing (CA & Federal) program is designed to give you a clear, practical understanding of how to approach summary judgment motions in both California state and federal courts, with an emphasis on what actually works in practice.

Hon. Kira L. Klatchko (Ret.), a former California Superior Court judge now in ADR with JAMS, comments throughout the program. Judge Klatchko served nine years on the Superior Court of California, Riverside County, including seven years presiding over an unlimited civil department, where she managed thousands of cases from inception through resolution. She also twice served as a justice pro tempore on the California Court of Appeal, Second District. Before taking the bench, she was a certified civil appellate law specialist and appellate practice leader, and she is co-editor of a leading California appellate treatise.

You’ll gain a structured, step-by-step framework for handling summary judgment from start to finish, including how to think about the motion early in the case, how to develop the record during discovery, and how to position your arguments for maximum impact. The program also addresses the critical differences between state and federal practice, particularly the procedural nuances that can make or break your motion.

From there, the faculty walk through the core components of effective summary judgment practice: selecting the right arguments, organizing your evidence, and drafting persuasive, well-supported motions and responses. You’ll also learn how to approach statements of undisputed facts and responses in a way that strengthens your position rather than undermines it, an area where even experienced attorneys often make costly mistakes.

Throughout the program, the speakers highlight common pitfalls and strategic missteps on both sides of the motion, along with practical guidance on how to avoid them. The goal is not just to explain the rules, but to give you the tools and judgment needed to use summary judgment effectively in real cases.

Our fabulous faculty includes Tracy L. Fehr of Alexander Fehr LLP, Jesse Lanier of the San Francisco City Attorney’s Office, Andrew Owen of Panish | Shea | Ravipudi LLP, Matthew C. Slentz of Colantuono, Highsmith & Whatley, PC, and Zachary A. Streiff of Downey Brand LLP. Between them, they include a deputy city attorney, a former federal district court law clerk, a former Superior Court research attorney, a former chief deputy public defender who has taken 25 jury trials to verdict, and a Certified Appellate Specialist.

Whether you are bringing or opposing a motion, this program will leave you better equipped to build a stronger record, craft more persuasive arguments, and avoid the procedural traps that can derail your case.

If your attorneys can’t attend live, the full program is available via OnDemand Streaming or Recorded Package Downloads. Group licenses are available for firms and agencies, and we frequently have government agencies and law firms purchase licenses for 8-15 of their attorneys.
